REPRESENTATIVE EXPERIENCE
Ms. Wilske began her practice at a boutique intellectual property firm in Century City, California. She assisted with discovery, trials and appeals in federal proceedings and wrote several winning motions for summary judgment and appellate briefs.
Ms. Wilske handled intellectual property litigation for seven years before joining an international trade association that represents major motion picture distributors. On behalf of the trade association, she worked on matters ranging from wrongful termination actions to trademark enforcement. On behalf of the motion picture industry, she coordinated a committee of studio antitrust lawyers and the industry-wide defense of antitrust litigation and investigations, and chaired film rating appeals and arbitration proceedings.
Ms. Wilske joined a major motion picture studio where she worked on film distribution and marketing matters for over nine years. During her tenure at the studio, she started and managed the studio’s film marketing legal department, served as resident expert for marketing and promotions legal issues, and was vice president of business and legal affairs for film marketing. In this capacity, she devised and implemented comprehensive procedures for the systematic review of all of the studio’s film marketing materials -- web sites, trailers, television, and print ads -- from intellectual property, labor, contract, privacy, and general liability perspectives. She developed compliance plans for film distribution and marketing groups and created contract templates for the film marketing legal department.
Ms. Wilske annually negotiated and drafted hundreds of diverse agreements at the studio. Such contracts included inbound and outbound licenses for content, software, and hardware; marketing and advertising contracts for strategic alliances, tie-ins, product placements, merchandising, music video and television production and distribution, special events, venue, catering, advertising agency and street marketing services; promotional contracts for contest and sweepstakes administration, sponsorship and fulfillment, as wells as online contest and sweepstakes rules and privacy policies; contracts for web site development and linking; and general business contracts for employment, consulting, strategic sourcing, creative services, professional services, settlements and non-disclosure agreements.
Returning to the Pacific Northwest to raise her twin daughters, Ms. Wilske joined a software company in 2005, where she negotiated and drafted licenses, joint marketing, service and distribution, product improvement and other software agreements; reviewed marketing collateral; and supported marketing, distribution, sales, and business development executives.
